1. Acceptance of Terms
By downloading, installing, or using AaharAI ("App"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the App. These Terms form a binding agreement between you ("User") and the developer of AaharAI ("we," "us," or "our").
2. Eligibility
You must be at least 18 years of age to use this App independently. Users under 18 may only use the App under the active supervision of a parent or legal guardian who accepts these Terms on their behalf. By using this App, you represent and warrant that you meet this age requirement or have such supervision.
3. Not Medical Advice — Critical Disclaimer
THE APP DOES NOT PROVIDE MEDICAL ADVICE. All content, food ratings, nutritional information, health insights, and AI-generated responses are for general wellness and informational purposes only. Nothing in the App constitutes, or should be construed as, medical advice, clinical diagnosis, treatment recommendation, prescription guidance, or a substitute for professional medical consultation of any kind.
You must always seek advice from a qualified physician, dietitian, or licensed healthcare provider before making any dietary change related to a medical condition, medication, or allergy. Never disregard professional medical advice or delay seeking it because of anything you read or see in this App. We expressly disclaim any liability for reliance on App content in place of professional medical care.
4. No Emergency Use
This App is not designed, intended, or suitable for use in emergency or life-threatening medical situations. Do not use this App to seek emergency assistance. If you believe you are experiencing a medical emergency, immediately call your local emergency services (112 in India, 911 in the US) or proceed to the nearest hospital emergency department.
5. AI Limitations and Accuracy
The App uses an AI language model operated by Anthropic, PBC to generate food ratings and guidance. You acknowledge that AI-generated content:
- May be inaccurate, incomplete, or outdated
- Does not account for your full medical history or clinical context
- Must not be used as the sole basis for any health, dietary, or medical decision
- May occasionally contradict qualified professional opinion
We make no warranty, express or implied, that AI outputs are correct, complete, safe, or appropriate for your specific health circumstances.
6. User Responsibilities
You agree to:
- Provide accurate information during setup — inaccurate data produces inaccurate recommendations for which we bear no liability
- Verify any nutritional or health information with a qualified professional before acting on it, especially if you have a diagnosed medical condition
- Not use the App for any unlawful purpose or in violation of any applicable law or regulation
- Not attempt to reverse-engineer, decompile, or extract the App's source code or AI prompts
- Not use App content to make, or encourage others to make, medical decisions without professional consultation
7. Prohibited Uses
You must not use the App to:
- Violate any applicable Indian or international law or regulation
- Transmit harmful, misleading, defamatory, or fraudulent content
- Attempt to gain unauthorised access to our systems, servers, or APIs
- Introduce viruses, malware, or other malicious code
- Impersonate any person, entity, or healthcare professional
- Resell, sublicense, or commercially exploit the App or its content
8. Intellectual Property
All content in the App — including text, graphics, logos, software, AI prompt architecture, and rating systems — is the property of the developer or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only. No other rights are granted.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, HEALTH OUTCOMES, USE, OR GOODWILL; OR PERSONAL INJURY ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED INR 100 (ONE HUNDRED INDIAN RUPEES) OR THE AMOUNT YOU ACTUALLY PAID TO USE THE APP IN THE THREE MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.
11. Indemnification
You agree to indemnify, defend, and hold harmless the developer and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to the App; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any health or dietary decision you make based on App content without professional consultation.
12. Third-Party Services
The App integrates Anthropic's Claude AI API. Your use of AI-powered features is also subject to Anthropic's Terms of Service and Privacy Policy (anthropic.com). We are not responsible for the data practices, accuracy, or availability of any third-party service.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to the arbitration clause below, you consent to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India for any dispute not resolved by arbitration.
14. Dispute Resolution — Arbitration
Any dispute arising out of or relating to these Terms or the App shall first be subject to a 30-day good-faith negotiation period initiated by written notice to contact.aaharai@gmail.com. If unresolved, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), conducted by a sole arbitrator mutually agreed upon by both parties. Arbitration shall take place in Bangalore, India, in the English language. The arbitral award shall be final, binding, and enforceable. Each party bears its own legal costs unless the arbitrator orders otherwise.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after any change constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the App.
16. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior and contemporaneous agreements, representations, and understandings.
